Terms of service

By commissioning me, you have read and agreed to these terms.

ENGAGEMENT
±THE ARTIST¬ I retain copyright, ownership, redistribution and intellectual property rights.¬ I warrant that I will not copy or heavily reference unauthorised materials.¬ I reserve the right to refuse projects or requests based on content, subject, or other reasons.¬ I define scope of work, features, price, deliverables and other details for the project in proposal in a format according to my discretion. The details set forth by me shall be agreed by the Client before work begins.¦
THE CLIENT¬ Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.¬ Client provides clear and complete requirement and expectations upfront.¬ Client receive non-transferable usage rights to the work for personal use such as : gift, wallpaper, personal prints, use on social medias with credit to the artist (@bigmovingcastle)¬ Client must not claim work as their own or trace, edit, resell or make profit from the commission.¬ Client must no use the preliminary materials (sketch,...) I provide for any other purpose beside commissioning me and your personal use.¬ Client must not use any part of the commission for non-fungible tokens (NFT), blockchain, crypto currency, AI image generator, etc.¦
PAYMENTS¬ Client pays in full up to 150€ value, or pays a 50% downpayment for higher value projects. (The final 50% is due after sketch approval).¬ Invoices must be paid within 7 days, or the project may be cancelled.¬ Prices are in EURO, and paid via Stripe, VGen or Ko-fi.¬ Prices may vary or change depending on complexity, requirements and/or additional requests.¦
CANCELLATION & REFUNDS¬ If Client requests cancellation : 1% to 20% of project fees may be forfeit if cancelled right before I start working on the commission.
The refund can be requested via email.¬ No refunds are possible after work begins.¬ If I cannot complete the work for unforeseen reasons, the Client may be eligible for a full refund. If work done up to this point is accepted and used by the Client, I will provide a partial refund according to the amount of work complete.¬ Please contact me first to resolve any issue.¦
TIMELINE AND WORKFLOW¬ Work completion requires 1 to 5 weeks. If there are any delays and adjustments to timeline, I will inform the Client.¬ I will work following the order and deadlines on Commission Board.¬ Process is divided into : sketch → color draft → finished artwork.¬ Client must first agree to delays and amendments to timeline exceeding 2 months through standard communication channels.¦
REVISIONS¬ 3 minor revisions are allowed during the process, free of charge. Additional fees will be charged for further revisions.¬ Additional charges for excessive revisions may be required.¬ Revisions may affect progress and timeline.¬ Please give feedback within 3 days. I will send a reminder after this delay. If there’s still no contact, I will start the next stage without waiting for approval.
